1. Agreement to Terms

By accessing clickwerxs.com, you agree to these Terms of Service. If you do not agree, do not use the Site.

2. Services

ClickWerxs provides digital marketing, web development, CRM software, and payment processing referral services. ClickWerxs acts as a referral agent and authorized representative for payment processing — we are not a direct payment processor. Merchant accounts are issued by our banking and processing partners, subject to their underwriting and approval processes.

3. Payment Processing Disclaimer

ClickWerxs facilitates merchant account applications and provides ongoing account management. Approval, rates, and terms are determined by the issuing processor and acquiring bank. ClickWerxs does not guarantee approval for any merchant account application.

4. Agency Services

Web design, marketing, and CRM services are provided under separate service agreements. All agency services are billed monthly and may be cancelled with 30 days written notice.

5. Refund Policy

  • Payment processing: No refunds on processing fees for completed transactions.
  • Agency services: If you cancel within the first 30 days and are not satisfied, we will refund the current month's service fee. After 30 days, services are non-refundable but may be cancelled at any time for the following month.

6. Intellectual Property

All content on clickwerxs.com — including text, graphics, logos, and software — is the property of ClickWerxs or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

7. Limitation of Liability

To the maximum extent permitted by law, ClickWerxs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of our services or this Site.

8. Indemnification

You agree to indemnify and hold harmless ClickWerxs from any claims, losses, or damages arising from your use of our services or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted to the Site. Continued use of the Site constitutes acceptance of modified Terms.
